5 tips for unauthorized use of your training content
A friend of mine shared with me the sad experience of one of her colleagues: a certified therapist, she herself designed a training course in her field. A few weeks ago she discovered that one of her learners is now using her training material to distribute it under her own name. What should she do?
1. Identify the evidence
It is important to check which training materials are used and to be able to demonstrate this. First of all, she has to take screenshots of all the sites on which she can find the information or the materials themselves.
2. Preserve evidence
For the purpose of legal proceedings, it will be necessary to make bailiff's reports on the Internet. For this, it is necessary to prepare a list of all the incriminating pages.
3. Identify possible witnesses
She can collect testimonials from witnesses who have taken the same training and describe its content in detail.
4. Give notice to cease
She can write a letter to the person who is using her contents improperly.
She can also contact a lawyer who will draft a cease and desist letter.
5. Taking action for infringement
If an amicable agreement cannot be reached, the company may bring infringement proceedings. It should be noted that it will always be possible to settle while the infringement proceedings are in progress. The representation by a lawyer will then be essential.
