Meeting about divorce


1. Family

Please bring your family members' birth certificates, your family record book and your marriage certificate.

2. Matrimonial regime

If you have a prenuptial agreement, it is advisable to give the signed version to your lawyer. Sometimes you have unsigned versions that have been changed before signing, it is important to contact your clerk (notaire in France) to get the version that has actually been registered.

If you do not have a prenuptila greement, the default legal regime applies under French law. Under French law, this is the regime of community property.

If you have lived abroad during your marriage, please prepare a calendar with the periods and places of residence.

3. The story of your relationship

How would you describe your relationship?

What led you to divorce today?

In the case of moral, physical or sexual violence, I suggest that you refer to the article on this subject.

4. You have children

Do you have children with your spouse or have you been the step-parent of a child of whom you are not the biological or adoptive parent?

I suggest you prepare the answers to these questions:

  • What are the dates of birth of your children?
  • Where do they go to school?
  • Who takes care of them on a daily basis?
  • What are their extra-curricular activities?
  • How much do you spend on average on your children (running costs, canteens, leisure centre, extracurricular activities, etc.)?

5. Financials

I suggest you prepare the answers to these questions:

  • What property did you acquire before the marriage or receive by gift or inheritance during the marriage?
  • What assets did you acquire during the marriage? and With what funds did you finance these acquisitions?
  • Are you a co-owner or a partner in an SCI?
  • Do you receive rental income from property acquired before marriage?
